These Terms and Conditions of CapTop S.r.l. (hereinafter referred to as “Seller”) apply to all sales contracts concluded between the Buyer (hereinafter referred to as “Customer”) and the Seller with respect to products for sale on the Seller’s e-shop.

All orders placed by the Customer and accepted by CapTop S.r.l. are subject to these Terms and Conditions, replacing and excluding the application of any other provision. Acceptance of the order automatically implies the Customer’s acceptance of these Terms and Conditions.

These Terms and Conditions may be updated periodically without notice. It is recommended to check this page from time to time in order to know any changes.

Conclusion of the contract

The products on sale at our e-shop are presented and described on the website itself, thus representing binding offers by the Seller. By completing the purchase procedure, the Customer accepts the offer on our e-shop. The contract for the sale of the products and services offered by CapTop S.r.l. is concluded at the moment when the purchase order made by the Customer is received by CapTop S.r.l. and CapTop S.r.l. accepts it. The Seller shall send the order confirmation to the Customer. The Seller does not accept the purchase offer sent by the Customer in the event that the object of the offer is not available in stock and/ or the Customer is unable to issue the payment. The Customer is required to carefully read these Terms and Conditions before sending their purchase order. By sending your purchase order, the Customer declares that he has read and accepted these Terms and Conditions and is obliged to comply with them.

The languages available for the purpose of concluding the purchase contract at our e-shop are Italian and English.

Payment method

Unless otherwise indicated by the Seller in the product description, the prices indicated by the Seller on the site are the final prices and are to be considered excluding VAT. Upon payment, the total price including VAT will be displayed in the shopping cart.

Any additional costs or discounts, where they exist, are indicated before the conclusion of the purchase contract in the description of the product and/or in the order procedure.

The Seller shows on the website the possible payment methods available to the Customer, who must indicate which method he intends to use during the order procedure.

The payment methods available to the Customer are PayPal or Stripe and the balance must be paid at the same time as the order is processed.

Is possible pay by bank transfer in advance by sending the request to info@captop.it in order to agree.

The products ordered by the Customer will remain pending until receipt of proof of transfer and no later than 5 (five) working days from the date of receipt of the order. After these periods, the order will be automatically cancelled.

Invoices will be sent electronically to the e-mail address provided during the account registration process. You can request a copy of the paper invoice by writing to info@captop.it and in this case CapTop S.r.l. reserves the right to collect postal charges.

Shipping and delivery

The products are shipped to the address indicated by the Customer at the time of order, by express courier. The shipping cost indicated in the cart, at the time of purchase.

In no case CapTop S.r.l. will be obliged to pay compensation, indemnities or penalties to the Customer for a missed or delayed delivery. Any liability of the Company for damages resulting from delay or non-delivery, total or partial, for reasons not attributable to the same such as even slight fault of the carrier or by accident or force majeure is excluded.

Right to withdraw

In accordance with current legislation, the Customer has a period of 14 (fourteen) days to withdraw from the purchase contract concluded online. The withdrawal period expires after 14 (fourteen) days from the day on which the Customer acquires the physical possession of the purchased goods. In the event that the Customer has purchased multiple goods in a single order, the period of 14 (fourteen) days starts from the day on which the Customer acquires the physical possession of the last good.

In order to exercise the right of withdrawal it is necessary to inform CapTop S.r.l. of the decision to withdraw from the purchase contract. The withdrawal decision must be communicated to CapTop S.r.l. by sending it or to the e-mail address info@captop.it (indicating in the subject “Request for withdrawal”)

The Customer is obliged to return the products without undue delay and in any case within 14 (fourteen) days from the day on which he communicated his willingness to withdraw from the contract of sale. Products must be returned to the following postal address:

The products must be returned correctly packed in their original packaging (in case of absence or damage to the latter, the Customer must ensure that the products are properly packed so that they are not damaged during transport). Products must not be damaged, damaged or soiled and must not show signs of use. The products must be equipped with all possible accessories, as well as the transport document and/ or tax receipt present in the original packaging.

Where the returned product does not comply with the requirements, the withdrawal will not be effective.

The shipping costs related to the return of the products – and any additional costs and/ or stock – are borne by the Customer.

Following the withdrawal from the online purchase contract, CapTop S.r.l. will refund the payment made by the Customer. This refund will be made using the same payment instrument used by the Customer at the time of purchase, unless otherwise stated. The refund may be suspended until CapTop S.r.l.receives the returned products.

Legal guarantee of conformity

The rules laid down by law shall apply in the event of defects in the goods sold.

For any complaint, the Customer can contact CapTop S.r.l. at the e-mail address info@captop.it (indicating in the subject “Complaint”).

Applicable law and place of jurisdiction

This contract is governed by Italian law and the exclusive jurisdiction for any legal action initiated by the Consumer is the Court of Naples.
